When Arizona parents go through divorce, the most common outcome is a situation in which shared children reside with one parent while the other receives visitation. In those circumstances, the non-custodial parent is often tasked with making child support payments to the parent with physical custody. Custodial parents rely upon that financial support to provide for the needs of their children. When child support goes unpaid or is unfairly calculated, the children at the center of the matter are the ones who will suffer.
An unusual child support case is currently making its way through the appeals process in one southern state. The case centers on a woman’s claim that her former husband conspired with his employer to hide a portion of the man’s income. That led to a child support determination that the woman claims is lower than it should have been.
In an unusual approach, the woman is asking that the state’s Supreme Court reviewed the matter. She is seeking to sue the employer for attempting to circumvent a valid child support order. The case is the first of its kind for that state.
As of the time of this report, it is unclear whether the state’s Supreme Court will review the matter. However, for parents in Arizona and across the nation, the issue of fraud in regard to child support is a serious matter. Many feel strongly that if an employer acts in a deliberate manner to reduce the amount of child support that a parent must pay, the employer should be held responsible.
