As the New Year gets into full swing, many attorneys in Arizona and across the nation are entering a very busy season. January is often called “divorce month” due to the high numbers of spouses who choose to file for divorce in the first few weeks of the year. This may not be news to many readers who are considering a similar move.

The reasons behind this trend vary from one couple to the next. In some cases, spouses have been thinking about divorce for a long time, but didn’t want to ruin the holidays with the news of a split. For a few, the holiday season served as one final effort to try and make things work. When that doesn’t happen, the resolution to seek a divorce becomes set in stone.

Another reason to avoid filing until the New Year is far more pragmatic. Many employees receive end-of-year bonuses. Those checks can be significant, and if a couple separates prior to the bonus check being issued, those funds are usually exempt from the property division process. So, waiting to file means that the bonus pay will be included in the division of marital wealth.

No matter why an Arizona spouse chooses to file for divorce in January, there are several things that should be accomplished before serving paperwork. By working closely with a divorce attorney, spouses are able to ensure that they have covered all of the bases prior to initiating the divorce process. That can make the months to come far easier to bear.
