What Is Paternity?

Paternity is the legal proof of a child’s parentage. Establishing paternity provides the father with both the legal rights and obligations of parenthood. Without paternity, a father has no legal grounds to establish child custody or visitation. Without the establishment of paternity, the mother is automatically granted sole custody of the children until paternity is legally established and the custodial status is changed.

With the establishment of paternity, a father (or in some cases mother) may be obligated to pay child support to the other parent. After paternity has been confirmed, the court may enter orders for parenting time and child custody.

Unmarried Parents And Paternity

A common misconception is that paternity can be proven by putting the father’s name on the birth certificate. Although this may be evidence of intended paternity, this will not automatically establish paternity. If an unmarried couple has a child, then additional steps must be taken to legally establish paternity. Until there is an order of the court stating that a specific man is the father of a child, paternity is not established.
